COMPENSATION RULES
EU REGULATION 261/2004
Fixed compensation for flights departing from any EU/EEA/Swiss airport regardless of airline, or arriving into the EU on an EU-registered carrier.
Triggers: Arrival delay of 3+ hours, cancellation with less than 14 days notice, involuntary denied boarding.
Extraordinary circumstances: Airlines are exempt only if they can prove the disruption was caused by genuine extraordinary circumstances (severe weather, ATC strikes, security incidents). Technical faults and crew shortages do not qualify.
Time limit: Claims can typically be filed up to 6 years after the flight (varies by jurisdiction).
US DOT RULES
The US does not have EU261-style mandatory delay compensation. However, involuntary bumping compensation is federally mandated, and airlines have made enforceable commitments through their Customer Service Plans.
For controllable delays, airlines have voluntarily committed to providing meals, hotels, and rebooking in their published Customer Service Plans. These commitments are enforceable via DOT complaint.
